Buffalo Wild Wings is being sued over delivery fees

A new lawsuit has been filed against Buffalo Wild Wings for being deceptive with their delivery fees.

Filed in the United States District Court for the District of Arizona, a class action filed by KalielGold PLLC (Case 2:21-cv-01947-DLR) alleges that Buffalo Wild Wings (BWW) has made “untruthful promises to provide a flat, low-price delivery fee on food deliveries ordered through is app and website.” Basically, Buffalo Wild Wings promises customers that their delivery fee will be $1.99. Once customers order, a service fee appears of $3, bringing the delivery fee to $4.99 instead of $1.99.

It should be noted that this lawsuit is not seeking a set monetary amount. After all, it is pretty hard to determine just how much Buffalo Wild Wings has made off this deceptive trade. Instead, they are asking that Buffalo Wild Wings show how much they made and that the money be returned to those included in the class action.

Some food for thought: The complaint included a nationwide study from Zion & Zion that the “largest user markets are the young and the poor”. The young part is not surprising, but it continues to state that the “less income a user earns, the more likely they are to have food delivered.” They are likely using this study to show that the tactics that Buffalo Wild Wings are using are not just shady, but predatory as well. In fact, this study found that people earning $10,000 or less a year tend to order delivery more than anybody else.
