Constables Arrest Suspected Drunk Driver with Two Child Passengers; Felony Charges Filed

HARRIS COUNTY, Texas – On August 14, 2023, deputies with Constable Mark Herman’s Office arrested a suspected drunk driver, identified as Jose Martinez, during a traffic stop in the 100 block of Spring School Road.

Martinez displayed multiple signs of intoxication, and open containers were found inside the vehicle. During the investigation, deputies discovered that he also had two child passengers, an 8-month-old and a 4-year-old, without child seats.

Standardized Field Sobriety Tests were administered, leading to the determination that Martinez was intoxicated. Further investigation revealed that he had a prior DWI conviction.

Jose Martinez was arrested and booked into the Harris County Jail, charged with Felony Driving While Intoxicated with a Child Passenger. His bond was set at $10,000.00 out of the 337th District Court, according to Constable Mark Herman.
